J&S Party Rental, Co – Rental Policies

This contract represents the complete and final agreement between the customer and J&S Party Rental Co. The customer acknowledges that this contract may be amended only in writing with a confirmed signature by both customer and J&S Party Rental, Co.

Inspection

Customer or authorized party acknowledges that he/she has or will have the opportunity to personally inspect the rental items prior to use and finds it suitable to customer’s needs.

Damage/Loss Responsibility

Customer is responsible for any damages to rental items while being in the customer’s care. Customer will indemnify J&S Party Rental, Co. for any damage, theft, or misuse of the items.

Damage waiver

The damage waiver fee is to cover rental items that have minor damage or wear and tear within normal use. If the cost of the damage or breakage of a rental item exceeds the amount originally charged, the customer is responsible to pay the full amount in order to replace the item. Damage waiver does NOT cover misuse, theft, vandalism, lost, or stolen items. This fee is NON-REFUNDABLE and is NOT insurance.

General Policies

1. All rental charges are based upon the confirmed reservation and time out for items. Refunds cannot be issued for unused items.
2. The customer is responsible for ensuring that the following is correct on the invoice: name, address, dates, times and quantity of items, sizes, colors, fabrics, is correct.
*J&S PARTY RENTALS, CO IS NOT RESPONSIBLE FOR ERRORS ON YOUR INVOICE THAT WE ARE NOT MADE AWARE OF.
3. Equipment will be inspected before it leaves the warehouse and when it returns.
4. All equipment is cleaned prior to rental, and must be returned in the same condition to avoid a 75.00 cleaning fee. *THIS DOES NOT APPLY TO LINEN RENTAL.
5. Pick-up and/or delivery service prices will vary upon location.

Reservations

• Estimates DO NOT guarantee availability of rental equipment.
* A 50% deposit is required for all rental orders.
• Order will not be finalized until payment has been completed. Final payment is due 48 hours before the event. For any last-minute rental orders made within the same week off event, full payment will need to be made.
• Any changes to your order must be submitted 48 hours prior to delivery/pickup of the event.
• Additional processing fees will be added for any last-minute changes. This also applies to cancellation fees.

Cancellations

If the customer decides to cancel the rental order with J&S Party Rental, Co, it must be at least 2 weeks prior to the event date in order to receive a 50% deposit refund. In the event that the customer cancels the rental order 2 business days prior, then a refund will not be given. Same day cancellations will not be issued a refund. If the weather prohibits J&S Party Rental, Co, or causes a delay within the given time frame, a refund will not be issued. If the customer cancels due to COVID-19, a refund will not be issued. J&S Party Rental, Co cannot control the weather and the inconveniences that may occur.
Note: J&S Party Rental, Co does offer the customer up to 1 year to reschedule their event.

Forms of Payment Accepted

• Cash, Visa, MasterCard, Discover, American Express, or Check
• If a customer pays in cash, then a credit card must be on file. The customer authorizes J&S Party Rental, Co to pre-authorize a charge or hold dependent upon the total amount of rental items.
• If a customer pays with a check, a copy of the driver’s license, address, state, and date of birth must be included.
• If a check is unable to be processed, J&S Party Rental, Co has the right to report it as a hot check.
• If J&S Party Rental, Co processes a check and it is unable to go through, then a $37.00 return check fee will be incurred.

Credit and Debit Card Authorization

The customer irrevocably and unconditionally authorizes J&S Party Rental, Co to immediately submit payment on the credit card. This also applies to outstanding balances the customer may have.

Taxes and Fees

Customers are responsible for paying sales taxes and fees applicable to the rental of items.

Signatures

This contract may be signed in multiple counterparts, each of which will be deemed valid and enforceable, as long as signatures are identical. For this purpose, facsimile and electronic signatures will be deemed the equivalents of originals.

Equipment Failure

In the event, any of the equipment begins to fail, become unsafe, or is in need of reparation; the customer agrees to immediately discontinue the use of equipment. Please contact our office at (214)-884-5713 to notify us. If it is after hours, please send a text to our messaging line at (469)-854-9763. There will be no refunds on any rental equipment unless the customer notifies J&S Party Rental, Co. about the problem.

Property damage

J&S Party Rental, Co does its best to protect your property during the delivery, installation, and removal process. Customer agrees to release J&S Party Rental, Co for any liability towards damage of property due to delivery, installation, and removal of equipment. This includes, but is not limited to, scratches or cracks on the installed surface, high wind related damages, driveways, lawns, sprinkler systems, gardens, septic tanks, drain fields and/or flowerbeds as a result of on-the-job deliveries or set ups.

Preparation of site

Customer agrees to have the site free and clear of all obstacles, natural and man-made, prior towards the arrival of J&S Party Rental, Co.

Customer Pick Up and Return

• Customer must present a valid ID when picking up rental items at J&S Party Rental, Co location.
• If the customer cannot pick up the rental items and would like to add another party, J&S Party Rental, Co must have the other party’s name, phone number, and valid ID. Additional party must be 18 years of age or older.
• The customer is responsible for loading and unloading rental items in vehicle. If the customer needs assistance to load and unload rental items in a vehicle, J&S Party Rental, Co is not responsible for any scratches, damages, personal property in or out of the vehicle, and if the straps become undone when the customer leaves.
• Customer agrees to return the rental items to J&S Party Rental, Co-location during regular store hours. All weekend rentals are due back on Monday before noon. If rental items are not returned before then, a late fee of $45.00 will be incurred per day.

Delivery and Pick Up

• Our regular delivery and pick up times are Monday through Friday from 10:00AM-1:00PM and 2:00PM-7:00PM. Saturday is from 9:00AM to 1:00PM. Sundays, holidays, and after hours will be charged at a higher rate.
• An estimated delivery time frame is given to the customer 48 hours prior to the event. If the customer would like a specific delivery time frame, an additional fee of $200.00 will be applied.
• Deliveries are done the day before the event at no extra charge.
• Customer will receive a text message with an approximate delivery time frame and update of the drivers whereabouts. Customer can reply to the text messaging line, but it does NOT accept phone calls.
• J&S Party Rental Co, employees CANNOT control any road complications such as weather, traffic, accidents, etc.
• Deliveries are made to the closest point where the delivery truck can park. Extra fees will be applied to deliveries inquiring going up the stairs, elevator use, or at any point where extra time is involved.
• Rentals will only be delivered to the garage door or front door, if an alley is not accessible. Employees are not authorized to leave rental items inside of customer’s home.
• If the customer is unavailable to receive the items at the time of delivery and another party is available, then the person receiving the items must be 18 years of age or older with a proper ID.
• If rental items are inside of a customer’s home, then it must be left outside in a secure sight for employees to pick up.
• Our service does NOT include set up and tear down of tables and chairs. If this service is required, arrangements should be made prior to delivery/pick up with an updated price quote. Tables and chairs MUST BE knocked down, stacked, and ready for pick up. Additional fees will be applied if these conditions are not met.

Before and After Hours Pick Up

An additional charge will be incurred if rental items need to be delivered and picked up either before or after office hours.
• Sundays: $300.00
• Holidays: $300.00
• Evenings: Before 10pm: $200.00, After 10pm: $300.00

Licenses, Permits, and Fines

Customers shall be solely responsible for payment of any licenses, permits and/or fines, required by or resulting from the customer’s use or operation of the rental items.

Disclaimer of Warrants

J&S Party Rental, Co does not provide a warranty that all rental items are brand new and free of latent defects for the customers intended use. J&S Party Rental, Co is also not responsible for any defect or failure that occurs if not notified. The customer must notify J&S Party Rental, Co for any failure or defect of the rental items. If J&S Party Rental, Co determines that the rental items are functioning properly, with no defects, then no adjustments will be made to the rental fee charged to the customer.

Electric power and lighting

Customer agrees to furnish J&S Party Rental, Co. access to the customer’s electrical and power lines for the installation and operation of the rental items.

China

China, glassware, and flatware must be returned rinsed and repacked properly in racks provided or additional charges will be assessed. If any items become damaged or broken during the rental period, the customer will be held responsible for the full cost of the item.

Linens

J&S Party Rental will provide a laundry bag for linens. The customer is responsible for returning the linen in the provided laundry bag DRY and FREE of any waste/damage. Please do not leave linen on the floor or grass. If there is any waste/damage, including, but not limited to, mildew, excessive stains, burns, tears, candle wax, or tape, customers will be charged the total cost of replacing the linen.

Tables/chairs

Any decorations that have been placed on tables/chairs will need to be removed before returning to J&S Party Rental, Co. Decorations are known to leave a residue or stain. The customer will be charged a cleaning fee or a replacement fee for a table or chair.

Tents

Before tent installation, it is the customers responsibility to:
1. Notify J&S Party Rental, Co in advance the type of area the tent installation will occur. The types of areas include grass, concrete, and asphalt.
2. Measure in advance to ensure there is an adequate space for a tent set up. (We also provide a service to come out and measure the tent area for $75.00). It is important to consider any trees that are in the way due to the high peaks of the tent. If there are any overhanging tree branches that may interfere, it is recommended to trim beforehand.
3. Obtain any necessary permits required by the city, county, and/or state.
4. Mark all underground utilities and obstacles such as: gas, electrical, water, irrigation, plumbing, and landscaping. It is recommended to call the utilities company to perform a DIGS Test at least 1 week prior of the event. If this is not done, then the customer does not hold J&S Party Rental, Co liable for any damages or repairs to subsurface utilities/lines and/or site property. J&S Party Rental, Co staff will take precaution if any digging or staking is required.
5. Mark the site of where the tent installation will occur. Once the tent has been installed it cannot be moved. If the customer requests for the tent to be moved, an additional fee of the original rental price will be incurred.
6. Provide a flat clear area free of sharp objects, debris (including pet fecal matter), toys, and non-rental items, including, but not limited to furniture, vehicles, plants, lights, etc. (If the customer fails to do so, before our J&S Party Rental Co staff arrives at the site, an additional fee will incur $100.00).

After the event is over, is it the customer’s responsibility to:
• Remove and clear underneath the tent of any decorations, debris (including pet fecal matter and food), toys, or non-rental items including, but not limited to furniture, vehicles, plants, lights, etc. (If the customer fails to do so, before J&S Party Rental Co staff arrives at the site, an additional fee will incur of $100.00).
*NOTE: NO cooking is permitted under or within the tent. Must be at least ten feet of tent.

Tent Weather Related Risks

J&S Party Rental, Co does NOT set up in high winds or heavy rains for the safety of our employees and your property. Tents are not intended to be used as shelter from severe weather; this includes storms, lightning, moderate to severe wind, heavy rains, snow, icing/sleet, gas leak, earth movement, fire, or any condition that may raise doubt of the structural integrity of the tent are immediate signs that an evacuation is necessary. It is the customer’s responsibility to ensure their guests’ safety. J&S Party Rental, Co ensures to set up the day before the event for any foul weather delay that can occur with same day installations.
NOTE: If sidewalls have been installed to the tent and high winds are occurring, J&S Party Rental, Co is not responsible for the flapping or billow that can occur.

Inflatables

Before installing the Bounce Houses, it is the customer’s responsibility to:

1. Notify J&S Party Rental, Co in advance the type of area the bounce house installation will occur. The types of areas include grass, concrete, and dry dirt. Unacceptable surfaces include loose gravel, wet mud, mulch, or sand.
*If the customer plans on cutting the grass, J&S Party Rental, Co asks that it would be cut at least 3 days before our arrival so that the grass clippings will not stick to guests or the bounce houses.
2. Measure in advance to ensure there is an adequate space for the bounce house set up. It is also important to consider any trees that are in the way. If there are any overhanging tree branches that may interfere, it is recommended to trim beforehand.
3. Obtain any necessary permits required by the city, county, and/or state depending on location of the event.
4. Mark all underground utilities and obstacles such as: gas, electrical, water, irrigation, plumbing, and landscaping. It is recommended to call the utilities company to perform a DIGS Test at least 1 week prior to the event. If this is not done, then the customer does not hold J&S Party Rental, Co liable for any damages or repairs to subsurface utilities/lines and/or site property. J&S Party Rental, Co staff will take precaution if any digging or staking is required.
5. Mark the site of where the bounce house installation will occur. It is important to factor the proximity of the source of electricity, as each blower motor must be at least within 50 feet of an outlett or generator. (We provide one extension cord per blower that reaches up to 50 feet). Do not connect the blower motors to the same outlet connection. Blower motors can draw between 115V-120V and will cause the circuit breaker to go out.
*When renting the waterslide, also consider the proximity of a water hose. Before inflating the waterslide, J&S Party Rental, Co will need the water hose ready for usage. (We do not provide water hoses)
6. Once the bounce house has been inflated, it cannot be moved. If the customer requests for the bounce house to be moved, an additional fee of the original rental price will be incurred.
7. Provide a flat clear area free of sharp objects, debris (including pet fecal matter and food), toys, and non-rental items, including, but not limited to furniture, vehicles, plants, lights, etc. (If the customer fails to do so, before J&S Party Rental Co staff arrives at the site, an additional fee will incur $100.00).
8. The customer is responsible for having guests not wear shoes, bring food (including candy/gum), drinks, silly string, and excessive dirt or grass in or on the inflatable. In the event that the bounce house is found dirty with gum, candy, excessive grass, dirt, pet fecal matter, or etc. an additional charge of between $75.00-$150.00 will be incurred. For silly string damages, a fee of $1,000.00 will be incurred due to it causing permanent damage on the vinyl.

After the event is over, is it the customer’s responsibility to:
Remove and clear around the bounce house any decorations, debris (including pet fecal matter and food), toys, or non-rental items including, but not limited to furniture, vehicles, plants, lights, etc. (If the customer fails to do so, before J&S Party Rental Co staff arrives at the site, an additional fee will incur of $100.00).

Inflatables Weather Related Risks

J&S Party Rental, Co does NOT setup in high winds or heavy rains for the safety of our employees and your property. In the event that there is a 50% chance of rain in the forecast, J&S Party Rental, Co will cancel your outside set up and apply the deposit to another available date within one year. Inflatables are not intended to be used as shelter from severe weather; this includes storms, lightning, moderate to severe wind, heavy rains, snow, icing/sleet, gas leak, earth movement, fire, or any condition that may raise doubt of the structural integrity of the inflatables are immediate signs that an evacuation is necessary. It is the customer’s responsibility to ensure their guests’ safety. J&S Party Rental, Co ensures to set up the day before the event for any foul weather delay that can occur with same day installations.
